This is the Privacy and Cookie Statement of Vastgoed Veiling. Vastgoed Veiling is a brand of TBAuctions Netherlands B.V. and is part of the TBAuctions Group, hereinafter referred to as TBAuctions. Other TBAuctions brands include:

If you are our customer, visit our website or contact our customer service, you share personal data with us. This may include your name, telephone number or email address. This concerns data that we can link to you. We therefore make every effort to process your personal data carefully. In this Privacy Statement, you can read how TBAuctions and its subsidiaries handle your personal data.

This Privacy Statement applies to all personal data that TBAuctions processes from anyone who uses our services, website or other applications and mobile platforms, referred to as the Platform, such as our visitors, bidders and customers across all TBAuctions-related domains, including all underlying entities and subsidiaries. This personal data is processed in accordance with applicable data protection legislation, in particular EU Regulation 2016/679, also known as the General Data Protection Regulation, or GDPR, as well as any future legislation and additional national legislation.

This Privacy Statement also explains how you can ask us to amend, restrict or delete your data. TBAuctions makes every effort to keep your personal data accurate and up to date. We need your help with this. Have your personal details changed? Please inform us of these changes by contacting our customer service.

TBAuctions is entitled to amend the content of this Privacy Statement without notifying visitors. Publishing the amended version on the website is sufficient for this purpose. The most recent version of this Privacy Statement can be consulted on our websites.

2. Who is responsible for processing your data?

TBAuctions Netherlands B.V. is a private limited company under Dutch law, located at Overschiestraat 59, 1062 XD Amsterdam, the Netherlands, registered with the Chamber of Commerce under number 63157764.

For the purposes described in this Privacy and Cookie Statement, the above companies are considered joint controllers, jointly determining the means and purposes for the collection, storage, disclosure, use and other types of processing of personal data.

Any reference to we, us or our in this Statement refers to TBAuctions.

3. What is personal data?

Personal data is any data that we can link to you. This includes your name, address, postcode, place of residence, telephone number or email address. Data such as your IP address and IBAN number are also personal data. The same applies to other data that is unique to you, such as your TBAuctions bidding data or purchase history.

4. Which personal data do we process?

As part of creating an account, TBAuctions collects personal data that is necessary to provide you with services and to perform the agreement with you.

For the creation of a private account, we collect and process at least the following personal data:

  • Title: Mr/Ms
  • First name and surname
  • Address, postcode and place of residence
  • Country
  • Email address
  • Mobile telephone number / telephone number / fax number, for SMS verification purposes

For the creation of a business account, we collect and process the following personal data:

  • Title: Mr/Ms
  • First name and surname
  • Company name
  • Address, postcode and place of residence
  • Country
  • Email address
  • Mobile telephone number / telephone number / fax number, for SMS verification purposes
  • Sector / industry
  • VAT number
  • Chamber of Commerce number, if applicable

For the creation of a business account as a client, meaning a seller, we collect and process the following personal data:

  • Title: Mr/Ms
  • First name and surname
  • Company name
  • Address, postcode and place of residence
  • Country
  • Email address
  • Mobile telephone number
  • VAT number
  • Chamber of Commerce number
  • IBAN number

For bids and for managing the website and its content, we process:

  • Technical and anonymized data
  • Your feedback about the use of our Platform and any other information you send us through the Platform’s functionalities, which enables us to improve the functionality of our website and Platform
  • Anonymous data that cannot be traced back to a person, for reporting purposes

For successful bids and purchases, we process:

  • Information about the purchased lot
  • Your bank details, meaning your IBAN number
  • Payment methods and when the payment was made
  • For some lots, your date of birth, if legally required

In exceptional cases, we may ask to view your identification document in order to establish your identity. On the Dutch government website, you can read more about making a secure copy of your identification document.

5. What is the purpose of processing personal data?

TBAuctions may collect, process and store your personal data within certain limits to ensure that TBAuctions can continue to function optimally. These processing activities are based on different legal grounds, depending on the specific circumstances. We handle your personal data carefully and take both technical and organizational measures to protect it.

TBAuctions processes and uses your personal data for the following purposes.

Entering into and performing an agreement

TBAuctions needs certain personal data from you in order to enter into an agreement with you and to properly perform and complete that agreement, including delivery. Without this data, we are unable to establish a relationship with you or perform an agreement.

The data collected, processed and stored for this purpose is necessary to create and maintain the relationship between you and TBAuctions correctly.

The necessary data is collected during the registration procedure for your account and subsequently during the relationship between you and TBAuctions. TBAuctions processes the following personal data for this purpose:

  • Name and address details
  • Email address
  • Mobile telephone number / telephone number

Legal obligations

In certain cases, TBAuctions needs your personal data in order to comply with legal obligations.

For example, we may use your personal data to combat money laundering and terrorism, to assist competent authorities with their investigations or to comply with tax legislation.

Anti-money laundering legislation and combating terrorism

As an auction house, TBAuctions must comply with international laws and regulations, such as those relating to the prevention of money laundering. TBAuctions is obliged to prevent, recognize, combat and report money laundering practices. TBAuctions processes the following personal data for this purpose:

  • Name and address details
  • Email address and telephone number
  • VAT number and/or Chamber of Commerce number, for business accounts

Tax legislation

TBAuctions is obliged to process customer data so that the tax obligations of TBAuctions and the customer can be fulfilled. TBAuctions is obliged to provide tax authorities with information and, in doing so, to share your data with those authorities. This includes, but is not limited to, the Dutch Tax and Customs Administration. TBAuctions processes the following personal data for this purpose:

  • Name and address details
  • Email address and telephone number
  • Invoice details
  • VAT number and/or Chamber of Commerce number, for business accounts

Judicial authorities

TBAuctions is obliged to assist and inform judicial authorities. This includes, for example, the police, the Public Prosecution Service, courts or supervisory authorities, including but not limited to the AFM, ACM and the Dutch Data Protection Authority.

This may involve all data that TBAuctions has collected, processed and stored in the context of the relationship between you and TBAuctions.

Privacy legislation

TBAuctions must also process your personal data precisely in order to protect your privacy. TBAuctions must be able to respond correctly when you wish to exercise your rights or when the Dutch Data Protection Authority asks us a question.

This may involve all data that TBAuctions has collected, processed and stored in the context of the relationship between you and TBAuctions.

Commercial purposes

The use of your personal data for commercial purposes, such as direct marketing, forms part of this Privacy and Cookie Statement.

TBAuctions would like to be able to contact you as a potential or existing customer and inform you about auctions that may be of interest to you. This may mean that you also receive information from other brands within TBAuctions. You will only receive newsletters containing information about our auctions. The personal data that TBAuctions collects, processes and stores for this purpose is:

  • Name
  • Email address
  • IP address

If you do not wish to receive the newsletter, you can unsubscribe, or opt out. To withdraw your consent, you can use the unsubscribe link at the bottom of our newsletters. If desired, you can also send your request to our Data Protection Officer by email at dpo@tbauctions.com.

Operation of the websites and apps

After your acceptance or consent, TBAuctions collects information about your website and app usage by means of cookies. The purpose is to provide you with the best possible experience in line with your preferences.

  • If you accept our cookies or have created an account, we may make you specific offers based on your browsing and purchase behavior, provided you have given us permission to do so.

Based on TBAuctions’ legitimate interest

TBAuctions may collect, process and store your personal data within certain limits to ensure that TBAuctions can continue to function optimally. If the optimal functioning of TBAuctions falls within the purpose described above of entering into and performing an agreement with the customer, that purpose will be relevant for TBAuctions when collecting, processing and storing your personal data.

In other cases, TBAuctions may rely on its legitimate interest. In doing so, a balancing test is always carried out between the interests of TBAuctions and the possible consequences for your privacy. TBAuctions always chooses an approach that protects your personal data as well as possible.

This applies to the following purposes:

  • To proactively inform potential and existing customers about TBAuctions’ services

  • To enable participation in webinars or online events

  • To enable relationship management

  • To handle communications and complaints from potential and existing customers

  • To carry out KYC, or Know Your Customer, processes when offering our services to new customers

  • To provide training and coaching to employees

  • To implement internal improvements to our services that benefit the customer

  • To offer you online auction services, including:

    • Facilitating online auctions on our websites and apps
    • Registering and closing auction bids
    • Informing participants about an auction and its progress
    • Providing information to a seller and/or customer as part of an auction and/or to a third party involved in conducting auctions
    • Preparing and issuing invoices
  • To store your personal registration details in a database in order to facilitate your future participation in auctions

  • To conduct audits and security checks in relation to the website

  • To inform you about functional changes to the websites and/or apps and to provide you with important information about participating in an auction or using auction services

  • To ask for your feedback on a new web page in order to optimize the website

  • If you accept our cookies: to measure your experience anonymously in order to optimize the websites and apps

  • In the event of technical issues: to resolve them so that your bid on a lot can be traced and to prevent your bid from being lost as a result of a technical issue

  • To enable you to collect goods or to enable the delivery service to send the goods you have purchased to you

  • To carry out our administration and comply with our tax obligations

In all other cases, TBAuctions will ask for your explicit consent. You have the right to withdraw consent you have already given at any time. You can exercise this right by contacting our Data Protection Officer at dpo@tbauctions.com.

6. Whose personal data do we process and how do we obtain this data?

We process the personal data of everyone who has had direct or indirect contact with TBAuctions, such as bidders and customers.

We obtain the data directly from you when you visit our websites or other applications and mobile platforms, create an account and enter certain details, or contact our customer service.

7. Personal data we collect automatically

Regardless of whether you participate in one of our auctions, we automatically collect certain information when you visit our websites or other applications and mobile platforms. This includes your IP address or the date and time you were logged in to our websites and/or apps.

8. Processing special categories of personal data

TBAuctions will not collect and/or process special categories of personal data from you, such as racial or ethnic origin, political opinions, religious or philosophical beliefs, or data revealing trade union membership, genetic data, biometric data for the purpose of uniquely identifying a person, data concerning health or data concerning a person’s sex life, as defined in Article 9 of the GDPR.

Sensitive personal data, such as creditworthiness, is only required in the case of special lots at auctions, such as aircraft or other expensive goods, to ensure that bidders are actually able to purchase such lots and to prevent payment and delivery problems. In some cases, we also work with civil-law notaries, lawyers and trustees in order to comply with legal requirements for the transfer of ownership.

9. Security of your data

TBAuctions takes the security of your personal data seriously. We have therefore taken both technical and organizational measures to secure your personal data.

10. How long do we retain your data?

We do not retain your personal data longer than is necessary for the purpose of processing. After that, the data will be deleted as soon as it is no longer needed, taking into account statutory retention obligations for data. The legal basis is used as the starting point, and the retention period is aligned with the period during which TBAuctions needs the data to achieve the purpose of the processing.

11. With whom is your data shared?

TBAuctions works with other parties to provide you with services and will only transfer information to third parties that fall within the following scope:

  • Affiliated companies: affiliated companies belonging to TBAuctions and its subsidiaries, provided that these companies offer comparable data protection and the transfer of data is permitted.
  • Service providers: we instruct other companies and individuals to work on our behalf. Examples of service providers include companies that offer delivery services or payment processing, such as credit card, direct debit and purchase on account, or professional bidding agents who act on behalf of customers. If TBAuctions uses the services of third parties, it enters into agreements with these parties that do not create any independent obligation for them with regard to the processing of personal data. These service providers have access to the personal information, including name and address details, email address and telephone number, that is necessary to perform their work, for example to have lots delivered. However, they are not permitted to use this data for other purposes.
  • Sellers: your personal data may be shared with our Sellers. If you make a purchase where the lot is sent to you, we will share your name, address and contact details, meaning telephone number and email address, with the Seller so that shipment can be carried out. If you make a purchase where the Seller organizes the collection day, we will share your name, address and telephone number with the Seller so that contact can be maintained with you about the desired collection time. The Seller may also contact you if you still have an outstanding invoice. Finally, we will share your data with the Seller if you have a complaint about your purchase and TBAuctions, in its mediating role, has not been able to reach a solution. The Seller will then contact you directly. Please note: if your contact details change during an auction, during a complaint or shortly after a complaint has been handled, we may provide your old contact details to the Seller if there is reason to believe that this is necessary for the Seller to obtain the rights arising from the purchase agreement.
  • In all other cases, you will be notified if your personal data needs to be sent to third parties and you will be given the opportunity to consent to this separately.

For every disclosure, we will ensure that the necessary contractual safeguards for the protection of your personal data are in place.

In all cases where personal data is transferred to third parties in countries outside the European Economic Area, or EEA, within the above context, we will only transfer the data in accordance with this Privacy and Cookie Statement and the applicable privacy protection regulations.

In principle, where possible, all data will be processed within the EU and will not be exchanged with parties outside the EU. Data may only be exchanged by TBAuctions with a non-EU country if the recipient can guarantee the same level of data protection, either on the basis of the legislation applicable in that country or through separate agreements as prescribed by the EU in the EU format for a binding agreement.

12. Which rights can you exercise with regard to your data?

Within the framework of the GDPR, you as a citizen have a number of rights in relation to TBAuctions. After all, it concerns your personal data. You can exercise these rights by sending an email to dpo@tbauctions.com. Requests in which you invoke rights acquired under the GDPR will be handled by us within 30 days at the latest. If we cannot process your request within 30 days, we will provide you with a response within 30 days explaining why your request cannot be processed within 30 days. In that case, we have 90 days to handle your request.

Right to information

You have the right to know how we handle your personal data properly and transparently and which rights you can exercise in this regard. In this Privacy and Cookie Statement, we have therefore explained in detail which personal data we collect from you and how we handle your personal data.

Right of access

You have the right to access the personal data we hold about you at any time. You can submit a request for access through our Data Protection Officer by sending an email to dpo@tbauctions.com. Please include your name, email address and account ID. In addition, we may ask you questions to verify your identity. Requests for access to your data will be processed within 30 days at the latest.

Right to rectification

You have the right to correct the personal data we hold about you if it is inaccurate or outdated, and/or to supplement it if it is incomplete. You can do this yourself in your account, 24/7.

Right to object

You have the right to object to the way in which we process your personal data. This right applies to the personal data we use for direct marketing, such as newsletters. You can ask us to stop using your personal data for personalized emails relating to our auctions. You can set this yourself in your account. This right also applies to other personal data we process about you based on our legitimate interest.

Right to data portability

You have the right to receive the personal data you have provided to us in the context of the agreement you entered into with us, so that you can store this personal data in a database of your own or of a third party. You can submit a request for this to our Data Protection Officer by sending an email to dpo@tbauctions.com. Please include your name, email address and account ID. In addition, we may ask you questions to verify your identity. You will receive a file in a machine-readable format, CSV or XML, containing your name, address and residence details, as well as your bidding data and purchase history.

Right to restriction

You have the right to submit a request to restrict your data. This means that we may store your personal data but may not use it. This right arises in a number of situations. If you believe this applies, you can inform us by email at dpo@tbauctions.com.

Right to be forgotten / account deletion

In some cases, you have the right to be forgotten. You can submit a request to have your account deleted through our customer service or through our Data Protection Officer. In that case, we will assess whether we can delete your data or whether we must retain certain data on the basis of a legal obligation.

You can ask us to delete all or part of your personal data. To do so, please contact our customer service.

Right to lodge a complaint

If you disagree with how we handle your personal data, you have the right to lodge a complaint. If you have a complaint, we would first like to resolve it with you. To do so, you can contact the Data Protection Officer by email at dpo@tbauctions.com. Please include your name, email address and account ID.

13. What are cookies?

TBAuctions places cookies in your browser when you visit one of our websites.

Cookies are small, temporary text files that are placed to ensure that our websites function optimally.

Thanks to cookies, you do not have to enter or download the same information every time you return to us. Convenient. Cookies also help us understand how you use our website so that we can make it better and more user-friendly. For example, cookies help us collect certain statistics for statistical purposes and analyze the number of page visits and the popularity of individual pages and topics. Preference cookies

Preference cookies allow our websites and apps to remember information that affects the behavior and design of the website, such as your preferred language or the region where you live. Preference cookies also help you select lots and save them to your favorites, so that you can return to view them later and decide at a later stage whether to bid on them in the auction. Preference cookies also make it possible to inform you when another user has placed a higher bid than you.

Statistics cookies help us understand the use of our auction platform and how we can continue to improve it by collecting and reporting data anonymously.

Marketing cookies / tracking

We use marketing cookies to track visitors when they use our websites and apps. The purpose of marketing cookies is to display advertisements that are relevant to the individual user. These advertisements are therefore more valuable to publishers and external advertisers. These cookies are also known as tracking cookies. Tracking cookies generally involve the processing of personal data. This may include, for example, the IP address.

Accepting cookies

For the best possible use of our websites and apps, it is necessary that you accept our cookies. When you visit our websites and apps for the first time, you will see our Cookiebot.
