Can I include a resolutive condition or suspensive condition?

This depends on the type of auction and whether resolutive or suspensive conditions may be used. The rules differ for foreclosure auctions, bankruptcy auctions and public auctions. Below we explain this by auction type.

Foreclosure auction

In a foreclosure auction, a buyer always purchases unconditionally. Reservations that are common in a private sale, such as obtaining sufficient financing or a housing permit, are not possible in this type of auction.

Make sure before the auction that you are certain you can obtain the required mortgage and any necessary permits.

Bankruptcy auction

In a bankruptcy auction, a buyer often purchases unconditionally. In that case, there are no reservations that normally apply in a private sale, for example regarding sufficient financing or obtaining a housing permit.
