Can any civil-law notary organize an auction?

Yes, in principle any civil-law notary may organize an auction. For a voluntary sale, that is usually not a problem.

For foreclosure auctions, such as sales based on mortgage rights or attachment, this is different. These auctions are legally complex, subject to strict rules and fixed deadlines. They require in-depth knowledge of legislation and regulations, as well as experience with the specific auction process. It is also important that the notary knows exactly how the process works and how communication with all parties involved must be organized.

Because this is specialist work, not every notary office carries out foreclosure auctions. Many offices leave this to notaries and auction houses that specialize in this area. They have the right expertise, systems and processes to guide the auction process smoothly and correctly.
