5. Why can’t you place a private bid in an attachment auction?
In an attachment auction, a private bid is not legally permitted. The law provides that in the case of attachment, only a public auction may take place.
Legal requirements
In the Netherlands, there are strict rules for attachment auctions, laid down by law and supervised by a bailiff or civil-law notary. These rules require the process to be public to prevent deals from being made behind closed doors. As a result, the handling notary cannot consider private bids and the property may only be sold through the public foreclosure auction.
